Please read the following Terms and Conditions (&#8220;Terms&#8221;) carefully before using our website or booking any of our services.<\/p>\n    <p>The use of this website and\/or the completion of a booking with Punta Mita Experience constitutes your full and unconditional acceptance of these Terms, as well as our Cancellation Policy and Privacy Policy.<\/p>\n\n    <hr>\n\n    <h2>1. Description of Services<\/h2>\n    <p>Punta Mita Experience offers tours, excursions, and adventure experiences (hereinafter, &#8220;Services&#8221;) in the region of Punta de Mita, Puerto Vallarta, and the Banderas Bay area in general.<\/p>\n    <ul>\n        <li><strong>General Inclusions:<\/strong> Unless otherwise specified in the detailed description of each Service, our rates include the necessary personnel for the safe operation of the tour (guides, captains, instructors, etc.) and the primary equipment required for the activity (boat, vehicles, safety gear, etc.).<\/li>\n        <li><strong>General Exclusions:<\/strong> Our prices do not include: Gratuities for staff, transportation to and from the departure point, food and beverages (unless explicitly stated), photography services, towels, or sunscreen.<\/li>\n    <\/ul>\n\n    <h2>2. Pricing and Payments<\/h2>\n    <p>All prices displayed on the website are in Mexican Pesos (MXN) and include applicable taxes. We reserve the right to modify prices at any time, but we will honor the price of any already confirmed booking. Payments are processed securely through our electronic payment gateways.<\/p>\n\n    <h2>3. Cancellation Policy<\/h2>\n    <p>All cancellations and requests to reschedule a tour are strictly governed by our <a href=\"https:\/\/www.puntamitaexperience.com\/en\/cancellation-policy\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Cancellation Policy<\/strong><\/a>. By accepting these Terms, you declare that you have read and accepted said policy.<\/p>\n\n    <h2>4. Customer Obligations and Responsibilities<\/h2>\n    <ul>\n        <li><strong>Punctuality:<\/strong> The customer is responsible for arriving at the designated meeting point at least 15 minutes prior to the tour start time. Delays may result in the loss of the Service without the right to a refund.<\/li>\n        <li><strong>Physical and Health Conditions:<\/strong> The customer is responsible for ensuring that all participants in their group possess a state of health and physical condition compatible with the booked activity. It is the customer&#8217;s obligation to review the specific requirements and restrictions detailed on each tour page before booking. Certain Services, such as the Playa Escondida tour, <strong>are not suitable for children under 10 years of age, pregnant women, individuals with back problems, heart conditions, or limited mobility.<\/strong><\/li>\n        <li><strong>Behavior and Safety:<\/strong> To ensure safety, participants are required to follow the instructions of the staff in charge at all times, behave respectfully, and not be under the influence of alcohol or drugs that could jeopardize the operation.<\/li>\n        <li><strong>Right of Admission:<\/strong> Punta Mita Experience reserves the right to deny service or terminate it prematurely, without a refund, to any person whose behavior compromises their own safety, that of the group, or that of the staff.<\/li>\n    <\/ul>\n\n    <h2>5. Intellectual Property<\/h2>\n    <p>The original content of this website, including text, proprietary photographs, logos, and design, is the property of Punta Mita Experience and is protected by copyright laws. Its use or reproduction without our explicit written consent is prohibited.<\/p>\n\n    <h2>6. Assumption of Risk and Limitation of Liability<\/h2>\n    <p>The customer understands and accepts that many of our Services are adventure activities that involve inherent risks. By booking a Service, <strong>the customer voluntarily assumes full responsibility<\/strong> for any risk, accident, injury, or damage to their person or property that may occur. Punta Mita Experience is not responsible for events beyond our direct control. In any case, our company&#8217;s maximum liability for any claim shall be limited to the total amount paid by the customer for the booking in question.<\/p>\n\n    <h2>7. Governing Law and Jurisdiction<\/h2>\n    <p>These Terms shall be governed by and construed in accordance with the laws of the state of <strong>Nayarit<\/strong>, Mexico.
